This is exactly the EU-EC complaint.

Yes, according to the EU, Intel can not sell below the cost of an "efficient supplier". The question is, who is this efficient supplier that we should use to set the baseline? There are only 2 players in this game. If public statements by both companies are to be believed, and if industry rumors have any validity then Intel is an efficient supplier and AMD is an inefficient supplier irrespective of volumes. Where is the baseline?
