The problem is that Intel is attempting to spin AMD's argument. Which augers poorly for their chances.

It's not who is the EEC because it doesn't matter anyway. The EEC argument doesn't appear to have any standing under US Law. That's the point. It's not a valid legal test according to Intel, but AMD wants it to be. Arguing exactly who is the EEC is inconsequential.
