Tax question - does the rule still apply whereby you can sell a stock and if you buy it back within 30 days it is not considered a sale?

Are you talking about "wash rules" where you cannot take your tax loss if you buy the stock back within 30 days of the sale?

I had someone tell me that as long as you are completely out of the stock for the month of December, you can claim your losses.
