If you exclude HSDPA/HSUPA functionality from a wcdma handset you don't need the HDR patents which are the basis for Qualcomm's stance on holding royalties at the std rate going forward? Isn't such a 2 tier royalty system Nokia's primary objectives? Given Nokia's success todate in not having to pay a red cent, why wouldn't Samsung also look to postition itself to play a similar game in a similar sandbox? Maybe Samsung is one of the two licencees left to "settle into perputity"?

No one knows what is in the contracts and, whatever the terms, they will only be made public after they become irrelevant through expiry.
