Mark, on any issue, it is impossible to prove a crime WASN'T committed. For example, I can't prove you didn't commit a crime on your computer five minutes ago. Or ten minutes ago. Or 30 minutes ago. Impossible for me to know or prove.

What's possible is law enforcement proving that a crime WAS committed. In the present case, they proved that Libby committed perjury.

But law enforcement could not prove any violation of the Identities Act had occurred. Law enforcement knew the facts and concluded that they couldn't prove a crime on that.
