I think its time for some light to be shined onto these processes.

It seems to me we need to back up a step further. This whole thing started right after 9/11 when the question of whether that was a crime or an act of war. That has never been settled. IMO the cleanest way of getting on the right track would be to go back and argue that formally and officially. If terrorist acts are crimes, then all those processes are moot. If it's war, then it's a new kind of war and the old war processes need to be revised and vetted.
