IMO the cleanest way of getting on the right track would be to go back and argue that formally and officially. If terrorist acts are crimes, then all those processes are moot. If it's war, then it's a new kind of war and the old war processes need to be revised and vetted.

That's EXACTLY what I have been trying (unsuccessfully) to say. I suppose that is what Bush was trying to do with the creation of those military courts, but without clarifying actual definitions of status very clearly, you wind up with challenges. Things were too muddled, and the process too unclear.

Holding men for years and years in a war that isn't really a war, gets pretty iffy.
