Yes, Dan was explaining that to me this morning- how there were the separate but equal decisions starting with Plessy v Ferguson in 1896-- that weren't overturned until Brown v Brd of Ed Topeka in 54.
Takes time. And times change.

And that was something Kennedy said the opposition was not taking into adequate consideration: the length of time these people have waited, and the uncertainty of when they WOULD be heard.
