No, if we have the evidence, we can detain them and charge them with conspiracy.

First of all, you have to have more than one person to have a conspiracy. An individual bomber makes a more than adequate terrorist.

Secondly, charging them with conspiracy is worthless unless you can convict. Convictions for conspiracy are unlikely at best. That's because conspiracies don't leave fingerprints or show up on security cameras. Sometimes you might find a paper trail but that is iffy for other than white-collar crime. Evidence is usually one of the co-conspirators who is persuaded to turn on his fellows. Unlikely. Unless maybe you want to torture them...
