Bob -

I see we were talking about slightly different things. I was talking about the role of the courts in balancing the power of the legislature, thinking more about the Supreme Court. You're talking about people filing lawsuits to bring about policy change.

As it happens, our system does allow its citizens to petition the government for the redress of grievances. That's also a good thing, in my opinion.

Court decisions are subject to appeal, so checks and balances apply there, as well.
