I did mean it seriously and not as a polarizing gimmick. I don't do polarizing gimmicks. Just trying to think ahead.

If we start prosecuting these guys in criminal courts, do you not think some defense attorney will bring it and other "failings" up at trial? It would be easy to throw every case out for some rights violation technicality. Not saying that would happen, but I can't believe that defense attorneys wouldn't test every single one.

Whatever happens as a result of this decision, there will be parties who aren't satisfied and there is a long list of potential follow-up complaints. Habeas corpus isn't the be all and end all. There will be parties who aren't satisfied until we just let them all or almost all go.

I noticed that no one comment on my notion of just doing that--letting them go. Other than the comment that no one will take them. Which is another problem/symptom that might be interesting to discuss. What do we do about that?
