I don't see anything unconstitutional about the execution, so I think the Supreme Court should allow it.

OTOH a practical argument against executing people who don't kill anyone is that if they face execution for less then murder, they might figure they might as well go ahead and kill the victim so that the victim can't talk about the crime.
