They do not have the patent on the "composition of matter" because phentolamine the chemical has been off patent for long time.

As far as I know, the only approved use for phentolamine is for treatment of high blood pressure. Since better pills have come along for that problem, phentolamine is no longer available in pill form.

As indicated above, if approved and with its use patent, Vasomax will be the only pill form of phentolamine that can be used to treat ED. Since no other pill form of this drug presently exists, the only way there could be another brand of phentolamine on the market would be if it were brought out as a blood pressure medication. Then doctors would have to wink and prescibe it for ED. I don't think many doctors would do that.

If Barr or anyone else marketed phentolamine to treat ED, it would be a clear violation of the use patent and they would probably get a spanking from the courts. I doubt that any company, even Barr, would even attempt to place itself in so untenable a position.

Patent protection is not a concern. Good luck!
