Nice hedge. But actually, Phil would refuse to play. He's not the type that suffers foolishness gladly, as the saying goes.

Let me be more direct -- for as long as hedge funds would continue to exist under such a rule as you propose, bear raids and other such wild swings would actually increase dramatically.

To understand this, though, you have to understand the Darwinian nature of hedge funds. When one is weakened, others that are aware of its plight will do everything they can to exploit that weakness and force the weakened fund to liquidate, allowing them to reap the profits.

So now picture a field where everyone is in on the plight of a weakened fund and has a road map telling them exactly what to short in order to maximize the exacerbation of that fund's problems.

Poor mom and pop won't know what hit them.
