Why do you assume that, for example, a married couple who happen to be lawyers have lots of cap gains and tax shelters (not counting their own home)?

Look, you are out of context...read what i_node said and then post again.

The assumption is a self employed, married lawyer making 300K ... now maybe you don't know any of these, but that was the assumption. This fellow is paying in the 50% range of his income in taxes, fed, state and payroll, not near 70% as DR maintains....and that's if he's self employed. If he works for another firm, cut that by ~7.5% further.
