1 - Yes, it DOES.

2 - Even if it did not, it would be besides the point. Congress has the power to regulate citizenship under the constitution. Congress has made rules for naturalizing citizens. The natural born citizens are those who do not need to be naturalized.

That is not the legal definition that was established by contemporaneous law.


Its a reasonable interpretation of the constitution even before the clarifying law, and the US law, from long before McCain was born, states that the children of two US citizens are themselves US citizens.

Already done, but I'll quote it again.

"The children of citizens of the United States that may be born beyond sea, or outside the limits of the United States, shall be considered as natural-born citizens of the United States."

In my last post I pointed out that that was from the 1st congress, I'll add more detail and say it was enacted in 1790. McCain is old, but he isn't that old...

Edit - Also "as laws passed after his birth cannot apply" is debatable, but this is an unimportant point, because its irrelevant. The law in question was passed more than 145 years before his birth.
