The Phantom Exclusionary Rule

Eric Luna, a professor at the Utah law school, has done work in Cuba assisting them with rewriting their penal code. Because of Hollywood, everyone knows the Miranda readings. Professor Luna related that what really gets foreigners is that we exclude evidence if it is improperly obtained in violation of the Fourth or Fifth Amendments.

In most of the world, improperly obtained evidence is 100% admissible. "Too bad, so sad. Guilty."
