Dude, that's like saying that the fact that the police compile information about crimes shows that the rules don't work. When the Reg SHO list dissapears, get very worried.

It PROVES that like every rule that has ever been in existance in the history of civilization... YES are not always followed. A growing list shows the SEC needs to get on the stick for sure (which according to the talking heads news they are getting their wake up call)... it does NOT prove they do nothing or that the rules are worthless.

<There are stocks on Reg SHO that have had fails to deliver for months, even years. I haven't heard of any broker losing his licence over this, but are you trying to tell be that the SEC can't tell who it is that hasn't delivered?>

I cant tell you FOR SURE that if the rules had zero effectiveness NO BROKER WOULD EVER BORROW STOCK... as it costs money. Therefore since 99% (my guess) of all shorts are actually DO get borrowed we can say the rules are (somewhat) effective... and FOR SURE are being followed the vast majority fo the time.
