I'm a bit less against confiscating such items. They would be cheap, not very necessary or useful for legitimate purposes (although this is a dangerous criteria because people can decide all sorts of things aren't necessary or useful), in this case it seems to be part of a plot, and your talking about confiscation, not conviction and imprisonment.
