I thihk there is way too much emphasis placed on the upfront payment; the kudos for the large upfront payment are, I believe, overblown. Upfront payments have been standard for Qcom's licensing agreements since the beginning of the Company. It is virtually a standard for the licensor to receive a fee upfront, plus royalties. That it was "substantial" was, in large part, determined by approximately 14 months in which Nokia paid nothing, and the fact that something was owed for the period of time since April 2007, gave the parties some leverage to hide the numbers.
