Lots of levels but the direct obligation runs to the broker/dealer. Is there collusion with manager? Given the large numbers here, it's hard to imagine that there is not manipulation under the guise of looking the other way. You are right that this is indirectly naked shorting the holdings and it creates another intermediate step through which the regulators apparently don't have the resources to track. It just shows how this scam continues. The guru bashers here used to brag how they could naked short in Canada. Then they moved it off-shore. Now with derivatives and ETF's, ex-clearing, arbitrage offshore, etc., they still feel safe. Nevertheless, we've seen the whining over the past few weeks as they carefully guard the door and claim "no such thing as naked shorting, manipulative shorting, paid bashing, fails to deliver, hedge fund collusion, MM abuse, etc."
