It's not 'air'.

It's the LEGAL RIGHT to transmit something over a radio frequency.

Just like land, they ain't making any more radio spectrum --- there is only so much. So the EXCLUSIVE RIGHT to use a certain part of the radio spectrum is VALUABLE.

There could be no viable radio or TV broadcasts if EVERYONE was free to transmit anything they wanted to (all at the same times) over the spectrum --- it would all be a mishmash.

The radio spectrum is legally OWNED by the nation as a whole (administered on behalf of the nation's citizens by their legal representatives). That is why it is referred to as 'public'.

The broadcasters do not own the spectrum they utilize for their broadcasts. (They never bought it.) It is loaned to them for their exclusive use by the government.

Exactly the same as a National Park is owned by AMERICA... or the Continental Shelf, etc., etc.
