They don't have to buy the stock to go short they have to borrow it from someone who is long. When you buy a stock it is long in your account if the traders for the broker are building a short position then they may borrow your shares to go short. I mention fiduciary deficiency because their analyst or retail broker are recommending you to purchase the stock while their book is short the stock. The illegal short sale is when they don't borrow the stock from someone who is long. There is no proper clearing of the trade. BTW, Does anyone know where the funds come from for the naked shorts when the trade failed to clear properly?
