The second trial, also brought by the State of Nevada, was supposed to start today, but it's "to be dismissed". That apparently doesn't mean that it actually HAS been dismissed:

	Mr. Pitaro advised this case is to be dismissed based on the other case
 	which is in trial. Mr. Merback asked to pass this for a status check for the
 	Deputy to confirm. COURT ORDERED, Trial date VACATED and matter set for
 	status check.

 	9/04/08 9:00 AM STATUS CHECK: DISMISSAL
