Indeed, but they can work out better protocols between the WH and the Senate. They used to have one before thing got so hostile. The pick was more collaborative, more give and take.

The WH, too, could use a different process to gather candidates make its nomination, were it so inclined. There are no rules in the Constitution. They could ask for different input. There's no reason why a bunch of insiders need to gather candidates, run them by the ABA, and then pick the most extreme one they think they can get away with. They could let people apply, post their resumes on the internet, and get comments from the public or do TV debates. I'm not proposing that, only trying to illustrate that there are other options.
