thnx to chance to see, as I didn't read through this:

On August 19, 2008, the Company received notification from The NASDAQ Stock Market indicating that the Company failed to regain compliance with the Market Value Rule for continued inclusion on The NASDAQ Global Market. Under the Nasdaq rules, Wave requested an appeal hearing before the Listings Qualifications Panel and expects such hearing to be held on October 23, 2008.
