No one is charging more than $5 when the going rate is $3.50. If they did so they wouldn't have any sales.

When they are charging $5 the going rate is $5.

I don't know that I'd call it nice, its not done in order to benefit others, its motives are for the benefit of the seller not the buyer. But it does in fact benefit the buyer, so its not "anti-nice".

and in many states, its illegal.

Nothing requires states to act rationally or justly. Price controls are a good example of when they are doing neither.
