No, I don't think so. Apple still ships Navigator with Macs. I don't see how IE being the default "prohibits or restricts Netscape's licensing, sale or distribution" since it's a non-exclusive agreement.

If Microsoft had cut a deal that prevented Apple from shipping Navigator, that might be a violation. Another point to consider is that I believe that consent decree only pertains to the Windows OS, not what MSFT does in other markets.
