The ultimate argument for R v W is the following,

Parent has 2 year old child with life threatening illness requiring organ transplant, etc from parent. Parent refuses. Is this a felony, or murder? No, because our system does not allow one persons rights to be violated for another no matter how despicable the situation. Now a parent has a 3 mos old fetus, fetus cannot survive outside of the womb, parent refuses to sustain its life (and thus has an abortion). Is this murder? Not unless case 1, above is murder.

This argument will almost surely win in a non-corrupt court. The reason the debate is not framed this way is because this requires that the fetus is treated as a "baby" which the pro-choice people do not want to concede, because they are dealing with smaller issues where it is in their best interest not to concede a fetus as a child. But if the rubber met the road, and R v Wade really was challenged in the courts, they would result to this argument and likely win.
