I am familiar with state per diems and the IRS regulations on them change from year to year.

No big deal. Right or wrong it can be corrected. Unlike the sneaky stuff done by Rangle. The State od Alaska claimed they weren't income. Now it is up to the Feds to determine if they haven't already a policy that acknowledged the per diem in one way or the other.

Generally states confer with Federal IRS prior to declaring if an item is taxable or not to the employee.
