I think (as previously posted here as well) that the cross license means all patents covered up until 2010 are part of the deal, and if the deal is not renewed, both sides retain rights of all the patents. What would change is that new patents would not be covered, so if something like x86-64 was patented afterwards, the other side would not have access.
