Case 2 is different from case 1 in that something actively harmful is done to the fetus's body.

I think you might be wrong about case 1 also.

What if a parent of a 5 year old child witholds necessary medical care or food or simply abandons the child? Do we do nothing? No, we don't do nothing. Its a crime. Certainly if a parent of a 5 year old does something harmful to the child's body, it is definately a crime.

The case of bone marrow transplantation may be different legally. Legal research would be needed to ascertain that.
