The primary difference in medical malpractice suits between Germany and the U.S. are that the Judge may appoint his own medical experts for a less biased view, in addition to those presented by the litigants. Plus there is are no jury decisions.

In the U.S. a large portion of each claim is for future medical care. In Germany the state, being the medical payor, is already liable for this future care, so the total pay-outs appear to be smaller than they actually are.
