. It is modeled on the Social Security Trust Fund, where money goes to the general treasury but is credited to the fund. In the original Highway Revenue Act, the crediting of user taxes to the HTF was set to expire at the end of fiscal year 1972.

In September 2008 the fund was depleted of funds and required a transfer of $8billion from general revenue funds, by act of Congress.[5] Currently the fund is projected to run out in 2009.[6]
