JEFF - I am sorry but size of position or being any part of company is completely irrelevant. he was provided with material information.

So lets just say I didnt sell MY GD @#$%^&*(+)_(&%^$ Citigroup at 3.99 Friday and had lunch my uncle friday who is C CEO and he told me they had a fed meeting on the weekend and I went long FRiday I would absolutely be subject to insdier trading charges.

CUBAN is a hot head and knew what he was doingw as worng - He did it in spite.

Size of your position has no relevancve - There absolutely is a Case. HIs only argument is that if that financing brings in cash and the shares only increase proportiantaly to leave thje NAV per share identical but it was a pipe financing
