mPhase Technologies - Penny Pumping?

I normally don't go after penny stocks since I've been burned in the past. But, I recently stumbled upon a company who has some interesting technology. The company is mPhase Technologies. MPhase is a publicly traded company on the OTCBB under ticker symbol XDSL. Their technology brings nanotechnology to batteries:

"Using a breakthrough in nanotechnology and microfluidics, we have developed a unique battery architecture that takes advantage of the characteristics of liquids to be super-hydrophobic on a nano-textured surface. This allows an electrolyte to stay suspended away from the electrode until power is needed, allowing an almost infinite shelf life."

The company recently pre-announced a partnership which will provide a distribution channel for their AlwaysReady Emergency Flashlight. The fact that they pre-announced the partnership seems interesting to me, considering it was mPhase that announced the news. Is this a classic example of pump and dump? The mPhase CEO has a less than perfect track record. A simple Google search on the CEO Ronald Durando will return some red flags.

I will invest in anyone who can help my iPhone's battery last more than a few hours. But, giving my money to a man who's been under litigation for for pumping and dumping penny stocks in the past...

I'm very cautious, yet very daring!
