That's an excellent article, but we shouldn't be surprised. When I first started posting about these issues on one of the basher/guru boards, I was ridiculed by one of the lead hypocrites for thinking that this problem could be, or even should be, addressed given the extent of derivatives (and options) that would subsume the traditional routes of naked shorting.

The bottom line is that these scammers find ways to manipulate. Back in the days when the shorty-gurus were so successful at the end of the high-tech bubble, they would brag about their overseas accounts, and I would joke that these accounts were really nothing more than bookie joints. There were no real margin rules. If you provided enough business and had cash behind you, these guys would find ways to manipulate via naked short. When I asked about domicile rules, they would indicate openly that trust and entity accounts got around those problems.

Of course, these are the same people who claim to be the Vigilantes who exposed scams and then claimed that their own scams should not be investigated, i.e., the Batman defense.
