As I read it, the DOJ case focuses on IE 3.0 and 4.0. Specifically, they claim that IE 3.0 and 4.0 have been marketed as seperate products, which makes them seperate products. For example, when Microsoft adds stuff to NT 4.0, they put out service packs. IE 3.0, on the other hand was sent out on CD-ROMS, bundled with ISPs, distributed to other OS's, it's in a product category on your Web site.....basically, all the things that are done with products, and not with operating system enhancements.
