Buddy, by your logic, if you see a thing you want and someone offers you something similar but less desirable item you rejected the thing you thought you wanted when you rejected the lesser substitute.

The Berg case was out there. (assume for a moment the worst case scenario that Obama is an illegal immigrant) The liberals may have rejected because a democrat President is more important than upholding the Constitution. And the constructionists may have rejected it to get to the Berg case.

When a case is rejected and you don't know the reason nor do I, your suggesting that it must be for the reasons you wish for is reaching.
