That's why we have contrived legal vehicles like patents, copyrights, and trademarks to give some semblance of protection to encourage sharing ideas.

The Man I took lectures on this subject from, Andrew J Galambos, proposed that a key problem with the patient system is that it did not allow for independent discovery, it all came down to "who gets there first." If you come up with an invention independant of someone else, his beating you to the Patient Office shouldn't stop your owning your version of it.

How to prove it? A review system would work. History is full of cases where one inventor was able to preclude another one who was independent of him.

We have degenerated today into a real patient mess, with one able to preclude and collect royalties on others my patienting generalizations that have no working invention at their core.
