The Madoff scheme was really kind of retro - quaint and unsophisticated. Post modern scamsters like Moody's, Ambac, (and the investment banks) operated at a much higher level, running their rackets right out in the open, staying within the letter of the law. So far, they have not faced any serious legal repercussions.

You wonder if someday soon GitMo will be used to house investment bankers and other financial terrorists. Could the assets of all former employees of Lehmans and Bear Stearns be seized under the RICO statute?
