The real issue is Madoff's derivative exposures. If he was short as a result of his market making activities (certainly not due to the necessity of maintaining orderly markets since margin levels have dramatically decreased) he's responsible to locating and providing it for eventual delivery. So someone's on the hook for all of that stock. But it's just amazing that NASD and SEC dropped the ball on their oversight responsibilities. The minute Madoff fell under investigatory suspicion, they should have been looking at his clearing activities. It's quite likely that the past couple of months have involved naked short selling activities in order to boost their balance sheet and pay off senior investors to keep the Ponzi scheme alive. This is what I TRULY FEAR is behind the years of NSS we've seen. Is it possible that our regulators have permitted the markets to all become one big Ponzi scheme where NSS has provided the $$$$?? What will be the consequences? Hawk
