McCain Feingold was blatantly unConstitutional yet the SCOTUS allowed it to stand. Public opinion does play into decisions.

Since no announcement on the Constitutional ability of Obama to serve seems forthcoming the most reasonable assumption appears to be that the SCOTUS believes it is a toxic issue. If the American people were apprised of the gravity of the issue by the pro democrat media the SCOTUS would have been more likely to rule on it.
