The point is simple:

If the US refuses to buy oilsands crude, they cannot claim Canada has denied them equal access. To do so violates NAFTA in the sense of adding conditions not expressed in the original treaty. It's up to Obama to decide, and I don't think he'll press the point - too many other problems.
