Bernie just lost the money and lied to investors about recent
returns, so they don't flee. That IS a crime, but not a "Ponzi
scheme" he's been accused of per se. It is possible to make
consistent returns through derivatives, and was certainly
possible before last year's Black Swan flew around.

Banks were doing exactly the same thing in the credit market, and
the US government just endorsed it by abandoning FASB 157, so
talk about justice. In case of banks, however, there is "no
market" for troubled assets, so prices "cannot be determined".
A whole lot of fraud has been going on. There will be no
public pity for the hedge funds, thou - they definitely will
be the casualties of the war.
