Crown ends case against accused ATM thief By Jana G. Pruden, The Leader-PostJanuary 15, 2009 A jury has heard all of the Crown's evidence against a man accused in two botched ATM heists and a police chase in a stolen truck.
Blaine Anthony Mozylisky, 33, is accused of breaking into the Four Seasons restaurant in an unsuccessful attempt to remove an ATM early on the morning of Jan. 29, 2008. The Crown contends Mozylisky made a similar attempt at a Mr. Sub restaurant location in the 1500 block of Albert Street a short time later, then fled when police arrived at the scene.
Mozylisky has pleaded not guilty to two charges of break and enter with intent to commit an indictable offence, possession of a stolen vehicle, and failing to stop while being pursued by police.
Surveillance videos shown to the jury at the start of the trial on Tuesday show a man in heavy winter dress and big black boots vigorously attempting to detach cash machines at the two locations.
Court has heard officers spotted a truck outside the Mr. Sub at the time of the break-in, and later tracked the vehicle to northwest Regina. The truck was then abandoned in the area, and police gave chase after a person who was seen running away.
The truck contained several items of interest to police, including prybars, a sledgehammer, a dolly and a plywood ramp. A pair of Sorels that had been in the truck when it was stolen were gone from the vehicle.
A number of police officers have testified that there were no other people and few vehicles on the streets at the time, as it was shortly after 4 a.m. and extremely cold.
Mozylisky was detained after being spotted walking in the area of the search. He was wearing big Sorel boots which matched fresh footprints found in the vicinity. Officers who dealt with Mozylisky at the scene said he appeared to have been outside for a long time, as his bushy moustache and beard looked like "a complete icicle." Mozylisky was wearing many layers of clothing and a pair of black Sorels when he was arrested.
The owner of the truck testified the boots seized from Mozylisky appeared to be the same as those that had been in his truck when it was stolen.
Crown prosecutor Randene Zielke and defence lawyer Jim Johnson are expected to deliver their closing arguments this morning. The jury will likely be charged by Justice Fred Kovach on Friday, and deliberations will begin after that.
