Steve, Here is the contents of the e-mail from C. Oppedahl. I am on a mailing list that you can sign up for just by going to his web site patents.com, I highly recommend adding yourself to the list. Here's that e-mail, plus a more recent one:

As you know, Mr. Fink, counsel for E-Data (IGE), filed a Report with the
court in the NY action. The report is 264 pages long and it will surely
take a while (at least a week and a half) for us to get it scanned and OCR'd
and HTML'd and posted to the web site. For now all that is on the web site
is a table of contents at <http://www.patents.com/ige/aug23np.sht>.

It is, of course, a public record. Anybody who wants to can stop by the
Manhattan federal courthouse and make a photocopy of it if they want to.

Meanwhile, if you absolutely can't wait, and want to have a copy of it now,
my suggestion is simply contact one or another of the defendants in the New
York action, and offer to pay for the copying and postage, and they would
probably run off a copy for you.

The September 1996 issue of Internet Underground has an article (p. 20) on
the E-Data case. In the article, Mr. Fink puts in a dig for the defense
lawyers.

"For Freilich and Fink, it's anything but a nuisance. They both say they're
having a good time, and Fink says the only people having more fun than them
are the lawyers for the defendants -- who he says are giving their clients
false hopes of defeating the patent in order to accrue billable hours
fighting it."
