You know, it occurs to me that these "claw back" rules might actually help perpetrate frauds like Madoff's. If you're invested or were recently invested in a scheme like Madoff's, and somehow discover that it's a fraud, or even have information that might help investigators, it suddenly becomes to your great advantage -- possibly even your imperative -- to keep such information AWAY from the authorities, in the hopes the fraud continues long enough for you to escape the reach of the claw back.
