Yes but he wants a conviction, and one that will hold up on appeal. He doesn't want sanctions for refusing to disclose information.

There are rules about disclosure, and he knows the defense will also research such issues themselves.

If the issues will get in the way of prosecution, the prosecutor will often try to make a deal, or if the issues are severe enough just decline to prosecute the case.

IANAL, but ask the lawyers on the thread, I'm sure they will back me up on this one.

Once you put enemy combatants in the ordinary criminal system, than you have to deal with these sorts of issues. That's one of the reasons why they often should not be put in to the ordinary criminal system.
