Your context of you question about shooting him in the leg is then more reasonable.

Let me make a criminal comparison.

I would consider him armed and dangerous just like a violent criminal who may be contained but not disarmed, a violent criminal who had his hostages hidden and buried alive with limited air supply. It is reasonable, even admirable and heroic to wrestle with an armed criminal in order to disarm him, rather than just shooting him outright, especially if having shot him would keep you from finding the hostages in time.

How do you wrestle with someone who is armed with information? Now we can get into the questions about interogation.

Just like with 'terms of surrender' as it relates to the definition of 'Captive' and the definition of 'torture'. We can't talk about one without consideration for the others.

Can we agree that there are differences in what is perceived as 'captured'. Being restrained does not always mean surrendered but in some cases it does, so one term does not fit all.

It is here, in which we lack sufficient codification.

I would allow you to 'wrestle' with the person you are talking about and would have few restrictions on that, as per my earlier statement, he is an armed threat who has not surrendered. Disarm him if possible, but all your actions should be restricted to that purpose alone. Torture by some definitions can go far beyond such a restricted course of action. So I would not consider or condone torture as a venue due to the broad sense we all have of the term.
